PROBLEM TO BE SOLVED: To provide a dielectric detection device and an occupant determination device capable of improving determination accuracy of existence of a dielectric when a shield electrode is disconnected. SOLUTION: In this device equipped with a sensor electrode 12 for detecting a capacitance value between itself and an earth electrode GND, existence of a person 1 between the sensor electrode 12 and the earth electrode GND is determined based on the capacitance value detected by the sensor electrode 12. In the device equipped with the shield electrode 13 disposed between a cushion heater 14 connected electrically to the earth electrode GND and the earth electrode GND and having the same potential as the sensor electrode 12, when disconnection of the shield electrode 13 is detected, electric connection between the cushion heater 14 and the earth electrode GND is released through a GND disconnection switch 15.
