An apparatus and a method for downloading data in a mobile terminal are provided to use a CPHS function through an SIM(Subscriber Identity Module) card not having the CPHS(Common PCN Handoff Specification) function by storing SMS message information in the SIM information of the SIM card. A mobile terminal(100) consists of a receiving part(10), a control part(20), an SIM management module(30), an SIM card(40), a display part(50), an input part(60), a transmitting part(70), and a memory(80). The receiving part(10) receives data. The control part(20) controls the received data. The SIM management module(30) analyzes information that indicates data contents among the received data, transmits it to the SIM card(40), and controls the SIM card(40). The SIM card(40) inserts the received information in an unused field of SIM information under the control of the SIM management module(30). The display part(50) displays information that indicates the contents of a message. The input part(60) inputs a command to download a message, equivalent to the information displayed through the display part(50), from a base station. The transmitting part(70) transmits the inputted command to the base station. The memory(80) receives and stores data, such as voice messages, fax data, E-mail, etc.
