PURPOSE: An image encoding apparatus and a method for selectively adopting a deblocking filter using the same are provided to selectively apply a deblocking filter, thereby preventing blocking deterioration at a specific level. CONSTITUTION: A deblocking filter application decision unit(220) obtains different image energy showing motion degree of an image by a value which subtracts a prediction frame from a current frame. The deblocking filter application decision unit compares the obtained different image energy with a predetermined threshold value. When the different image energy is larger than the predetermined threshold, the deblocking filler application decision unit applies a deblocking filler to an inputted intermediate output frame. When the different image energy is smaller than the predetermined threshold, the deblocking filler application decision unit does not apply the deblocking filler to the inputted intermediate output frame.
