PURPOSE: An apparatus and a method for determining the position of a pickup are provided to allow the optical disk to be operated more than 90 minutes without requiring an additional hardware. CONSTITUTION: A method for determining the position of a pickup includes the steps of: (a) measuring(500) the spindle rotational speed at the position of pickup, from an absolute time-code in pre-groove(ATIP) information, if the current pickup is determined that it is positioned at the region corresponding to more than 90 minutes area; (b) determining(504,505) the pickup to be positioned at the lead-in region when the rotation speed of the spindle motor is above the inner peripheral reference value from the determined result; and (c) determining(506,507) the pickup to be positioned at the lead-out region when the rotation speed of the spindle motor is below the outer peripheral reference value from the determined result.
