PROBLEM TO BE SOLVED: To provide a flat nonaqueous electrolyte battery wherein in case a case is swollen and deformed in high temperature environments, break of sealing structure of a positive electrode can and a negative electrode can be prevented, and further when a battery is assembled, an assembling insufficiency in which a positive electrode material is damaged can be prevented. SOLUTION: This battery includes the positive electrode can 5, the negative electrode can 6, a positive electrode material 2 housed in the both cans 56, a negative electrode material 4 and a separator 3, and is sealed via a gasket 7 in which the positive electrode can 5 and the negative electrode can 6 are arranged between peripheries of the both. A sealing 10 abutted on the gasket 7 is installed at the periphery of the bottom wall of the positive electrode can 5, and the positive electrode material 2 is housed in a concave part 9 installed at a more inner side position than that of the sealing wall 10 in the diameter direction. In the high temperature environments, this influence extending to the sealing wall 10 due to swelling and deforming the bottom wall of the concave part 9 is prevented. The negative electrode material 4 is housed in a housing part 13 installed at the upper wall side of the negative electrode can 6. The ratio of an inner size of diameter dimension D1 of the housing part 13 and an inner size of diameter dimension D2 of the concave part 9 is set in D2/D1=1.01 to 1.2, thereby that the positive electrode material is damaged is prevented in the assembling process.
