PROBLEM TO BE SOLVED: To provide a code amount controller suitable especially at the time of performing variable bit rate encoding in real time in the high efficiency encoding of moving images. SOLUTION: This moving image encoder for encoding the moving images is provided with a means 23 for detecting the generation code amount of the respective images, the means 22 for detecting the average quantization scale of the respective images, the means 33 for setting the target average code amount of the respective images, the means 32 for setting the margin portion of the code amount, the means 14 for deciding the allocated code amount of a prescribed section from the generation code amount, the quantization scale, the target average code amount and the code amount margin portion and the means 34 for setting a minimum quantization scale. Thus, the quantization scale for performing encoding next is decided by the quantization scale corresponding to the allocated code amount, and in the case that the quantization scale corresponding to the allocated code amount is smaller than the minimum quantization scale, the quantization scale for performing encoding next is decided by the minimum quantization scale.
