PURPOSE: An overload controlling apparatus in a mobile communication system and a method thereof are provided to reflect the flexible traffic volume when controlling the overload of a mobile switching center (MSC) / serving GPRS support node (SGSN), thereby enabling to set the standard traffic volume which is the standard of the reduction level. CONSTITUTION: If the value of the reduction level is decided, a standard traffic value setting unit (730) calculates the number of initial direct transfer (IDT) which is flowed in for all calling types during the predetermined time. The standards traffic value setting unit uses the number of IDT of the calling types to set up a plurality of standard traffic value depending on a plurality of reduction level. A control unit (740) limits the callings depending on the decided value of reduction level, based on the standard traffic value which corresponds to the decided value of reduction level among the plurality of standard traffic values.
