<P>PROBLEM TO BE SOLVED: To make a laser beam reflected from a target recording layer which is a recording layer among a plurality of recording layers of a disk recording medium, in which the recording or reproducing an information signal is being performed, incident largely on a light receiving element, and to make the laser beam reflected from the other recording layers not incident on the light receiving element. <P>SOLUTION: The reflected light reflected by the target recording layer of an optical disk 2 passes a transmitting film 121 of a prism 104, passes a relay lens 103 and polarization BS102, and is made incident on a light receiving element 107. Stray light reflected by the recording layers other than the target recording layer of the optical disk 2 is absorbed by an absorption films 122A or 122B, and is not incident on the light receiving element 107.
