PROBLEM TO BE SOLVED: To provide a dynamic delay ACK(acknowledgement) controller in a mobile terminal that can eliminate a relay by a duplicate ACK due to inverted packet reception sequence on the occurrence of temporal path duplication in the case of application of a path optimizing function of a Mobile IP(internal protocol) at handover so as to avoid wasteful packet re-transmission by a server thereby enhancing the throughput of entire communication. SOLUTION: On the occurrence of detection of hand-over by a link state inspection processing section 32, a delay ACK start/end designation section 34 sets a delay ACK reply period to confirm the reception in the order of a sequence number from a base station unit. When the period is set at packet reception, when a function of a reception sequence number inspection section 40 and a timer processing section 44 detects that the sequence number of received packets is not a sequence number to be substantially received, the duplicate sequence number is not transmitted to the base station unit through the dynamic delay ACK control.
