PROBLEM TO BE SOLVED: To provide data communication equipment, capable of lowering the possibility that an RTCP control packet and an RTP data packet are discarded due to congestion. SOLUTION: When an RTCP control part 18 is notified from the a data communication quantity measuring part 6 that it is the time, when data communication quantity is small, the part 18 instructs an RTCP control packet generating part 10 for generating and transmitting a RTCP control packet, when the generation designated time of an RTCP control packet arrives. Meanwhile, when the part 18 is notified from the part 6 that it is the time, when the data communication quantity is large, the part 18 once holds the generation and transmission of the RTCP control packet, and instructs the part 10 to generate and transmit an RTCP control packet after being notified of the effect that it is the time, when data communication quantity is small.
