PURPOSE: A method for determining a candidate intra prediction mode and an apparatus using the same are provided to transmit the intra prediction mode information of a predicted block with a less number of bits, thereby improving the efficiency of image encoding decoding. CONSTITUTION: If first and second candidate intra prediction modes are not identical, an apparatus sets one of the first and second candidate intra prediction modes to a first most probable mode (MPM) and sets the other to a second MPM (S400,S403). If one of the first and second MPMs is not identical to a planar mode, the apparatus sets a third MPM to the planar mode (S405,S410). If there is the same mode as the planar mode and one of the first and second MPMs is not identical to a DC mode, the apparatus sets the third MPM to the DC mode (S415,S420). If one of the first and second MPMs is the same as the DC mode, the apparatus sets the third MPM to a vertical mode (S425).
