A device and a method for forming an image are provided to enable the control of a data transmission rate, thereby stably and accurately transmitting image data, which are scanned by the device, to a server on the network. An image forming device scans a document. A data transmitter(150) transmits data of the scanned image to a server. A controller(140) controls the data transmitter to control a transmission rate of the image data correspondingly to the server. A storage unit(130) stores a list of servers having a history of occurring data transmission errors. If the server to which the image data are transmitted is included in the list, the controller controls the transmission rate of the image data. If the server is included in the list, the controller controls the data transmitter to transmit the image data at a preset transmission rate.
