<P>PROBLEM TO BE SOLVED: To securely return a forming plate to a waiting position by easily detaching the forming plate from a medical staple after bending the medical staple without changing a compression spring to the one with strong spring force. <P>SOLUTION: In the stapler, an anvil 11, on which the center of a crown 12a of the staple 12 is placed, is formed on an ejecting part 5 of the staple 12, and the forming plate 8 with a shaping groove 13 opened at the lower end is disposed above the anvil 11 in such a way as movable in the vertical direction. The stapler also has a return preventive projection 27 between the anvil 11 and the forming plate 8 for preventing the staple inside the shaping groove 13 from returning in the return operation after a wound is sutured as the forming plate 8 is moved downward by an operating lever 2 to bend both sides of the crown 12a of the staple 12 on the anvil 11 to the inner side of the shaping groove 13.
