PROBLEM TO BE SOLVED: To provide a photographic sound authenticating apparatus for a mobile communication terminal by which the illegal usage of a photographic sound is prevented by detecting the output level of the photographic sound and adapting only the photographic sound where the detected output level is not less than a predetermined reference level, and to provide its authenticating method. SOLUTION: The apparatus adapted to authenticate the photographic sound in the mobile communication terminal comprises a controller adapted to compare the output level of the photo-shutter sound selected by a user among the photographic sounds preserved in an SP (Service Provider) server against the predetermined reference level, and outputting a control signal based on a result of comparison; and a photographic sound determination unit for determining whether downloading of the selected photographic sound is performed or not, based on the control signal.
