PROBLEM TO BE SOLVED: To provide an occupant discrimination device and an occupant discrimination method capable of discriminating an occupant operating an operation part of an apparatus while minimizing modification of the apparatus installed in a vehicle.SOLUTION: An occupant detection device for detecting an occupant seated on a seat of the vehicle and operating the operation part of the vehicle includes: an electrode (12) attached to the seat; a capacitor (11) connected between the operation part and predetermined potential; a signal generation part (13) for generating a predetermined AC signal; a load (14) connected between the electrode and an output part of the signal generation part to transmit the AC signal to the electrode; and a discrimination part (15) for discriminating a signal level of the electrode. |
