PROBLEM TO BE SOLVED: To solve the problem that encoding efficiency is not improved since a quantization parameter is determined irrespective of a characteristic of an image although a rate can easily be controlled on the basis of code length while encoding is performed in a case where a difference with the quantization parameter of a block is calculated in a code order when a difference value of the quantization parameter is encoded in a conventional encoding system.

SOLUTION: For improving accuracy of a prediction value of a quantization parameter, the prediction value of the quantization parameter of a target block is calculated from the quantization parameter of a peripheral block by referring to a prediction mode, a reference picture, a motion vector and the prediction value of prediction reference information.
